TERMS AND CONDITIONS

General Policy Effective 2008

Acceptance and/or installation of the product purchased constitutes agreement in full, of all provisions of this document.

Warranty:

Weldtron warrantees all new products manufactured against normal parts failure and defective workmanship for a period of one (1) year from date of purchase. All repair services carry a ninety (90) day warranty from date of repair and the provisions below apply. We will either repair or replace the product free of charge for products qualifying for warranty. Products with valid warranty services will be shipped back via UPS ground at our expense. Any other shipment means will be at the expense of the owner of the product.

Normal parts failure is internal, or physical failure. of a single (or multiple parts) part due to manufacturing defects by the vendor or manufacturer of an individual part utilized in our product. Defective workmanship is a product's failure due to sloppy or poor quality of work or design.

Repair warranty only covers the actual specific repair action and the parts utilized in the repair. Other failures not associated with the repair are not covered by the repair warranty. Repair warranty does not extend the original warranty of the whole product beyond the original timeframe.

Warranty does not cover failure due to any of the following causes:

Physical or accidental damage to the product.

Damage caused by any devices connected external to our product.

Failure to install exactly per instructions supplied with the product or by instructions provided by the manufacturer.

Failure to use the product for the intended purpose for which designed.

Unauthorized modification or attempted repairs of any kind to the product or the manner provided for installation.

Abuse, neglect, and/or failure to protect the product from weather and the elements, or other damaging agents.

Warranty is voided by the following:

Removal, covering of, destruction, or tampering with, any Weldtron tags or identifying information.

Removal, alteration or tampering with a serial number of any product.

Attempted repairs, modifications or alterations by anyone other than Weldtron

Returning products for warranty service:

To return a product for warranty service, the purchaser must obtain a Return Materials Authorization (RMA) to do so. The RMA will have a control number assigned and will note the product, owner's information, and the problem with the product. Most importantly, when the customer calls for a RMA, in many cases, after the problem is discussed, they will find that the problem lies elsewhere in their machine and not in the product. It the product is to be sent in, a RMA number will be given to the customer. We reserve the right to turn away any package sent to us for either regular or warranty repairs that does not contain an RMA. Weldtron does not pay freight for any device shipped in for repair for warranty. We found that over 85% of all products returned for warranty repairs were not defective or warranty was voided due to abuse, tampering or problems external to the product. For this reason, it is very important to speak to technical services prior to sending in a product for repair.

A product returned for warranty that does not have any physical or electronic problems will incur a flat rate $25.00 charge for the time expended in attempting to find a problem that did not exist, plus repackaging for shipment.  Freight charges for the return of the product will be applied in addition to the charges for service.  A product returned under warranty for repair that does have a problem falling under a warranty rules shall be repaired (or replaced) at no cost and additionally, no freight charges will be applied to the return shipment.

When a product is received for repair and qualifies for warranty ,we pay only standard United Parcel Service ground freight to return the product. Other freight means are paid by the customer. If the product is not covered under warranty, we charge shipping costs. If a product is received for warranty (or regular) repairs and is not found defective, a charge for technical services, return freight, and repackaging will be incurred.

Returning products for regular repairs:

The procedures for obtaining an RMA are the same for standard repair actions for older products that are not covered by warranty.

The following rules apply to the return of product for credit:

All sales are final and the product cannot be returned unless ALL of the following procedures and stipulations are followed:

The product must be purchased directly from Weldtron

The product must not have any physical or electrical damages.

The original factory plastic wrapping must be undisturbed.

The product must be returned to and received by Weldtron within ten (10) days from the date of purchase.

The product (or any of its parts) shows no signs of being installed or used.

The product must be returned in its original shipping container along with the original installation instructions, accessories and/or installation hardware.

All qualifying returned products will incur a twenty percent (20%) testing, repackaging and restocking charge based upon the current retail price for the item. Once the product is inspected, tested and repackaged, the customer will be given a credit on the original purchase less the cost of original shipping freight, restocking charge, testing charge and percentage of sales tax (if any).

Weltron, Inc. reserves the right to refuse sales or service to anyone, anytime or for any reason that is legal.

Mechanic's lien:

When a product is received and/or repaired and the customer does not provide valid payment, return information, or fails to return our messages concerning the disposition of their repairs, or the payment thereof, for a period exceeding thirty (30) days, we hold the right to sell the subject product for all costs involved in repairing, storing and/or handling the product.

Liabilities:

All products designed, manufactured and sold by Weldtron are specifically designed for engine driven welding machines, specifically designed for only welding and for no other purpose. Weldtron shall be held harmless for any and all damages or costs arising from misuse, wrongful application, defective installation or any (and all) liabilities arising from any deviation of the purpose or installation instructions, and/or application of our product. Weldtron shall be held harmless for any and all liabilities arising from any person (or business) causing loss or damage to machinery, person, income or property due to failure to follow installation procedures, lack of technical expertise, failure to utilize the product as designed, and by use on any machinery or device not specifically designed as an engine driven welding machine designed only for the purpose of portable welding.

Recovery of debt:

Upon receipt of the product listed on this invoice, you agree to pay any and all costs involved for us to collect the amount owed in the event of violation of our credit policies or by payment of invoice by means of fraud or worthless instrument of payment. You further agree to pay any and all additional cost that may be incurred in the collection of said amount.

No Sales:

Upon any financial loss intentionally caused by any customer, for any reason, and by any manner, that customer shall be denied sales and services into perpetuity. That customer's business and individual's name shall be recorded within our databases and all sales to that business, or customer, shall be blocked even if the loss is recovered, in part, or in full.

General credit terms:

Our credit terms are as follows:

Credit is granted for qualifying commercial accounts for a period of 30 days from the date of invoice. Each invoice is fully payable and due not later than 30 days from invoice. Purchase orders and internal delays due to unique processes within a company are not valid reasons for non payment within terms. Whenever possible the internet us used for billing, purchase order transactions and communication. The use of FAX is highly discouraged due to the antiquity and labor intensive process utilized in sending and receiving faxes. The US postal system is rarely used due to ineptitude and unreliable distribution system.

Accounts reaching 45 days from invoice date are placed in "credit hold" and "overdue notices" are given to the delinquent customer. Once an account reaches 60 days from invoice, it is closed and collection actions begin. The customer is placed on the "No Sales" list and all sales and repairs are suspended on a permanent basis.

AGREEMENT:

Acceptance of delivery of the goods shown upon the face of the invoice constitutes full agreement to all terms cited above.
